General terms and conditions
Scope of application
The following principles form the basis for a successful cooperation between MENSCH IN BEWEGUNG and its clients and apply to all business transactions; conflicting terms and conditions of the client are only valid if they are expressly recognised in writing by MENSCH IN BEWEGUNG. Agreements deviating from or supplementing these GTCs must be made in writing.
Confidentiality
Both parties undertake to treat all information made accessible in the course of the cooperation as confidential. This obligation shall also apply beyond the end of the cooperation. This applies in particular to electronically processed information and data.
Prices
Price information received verbally shall be regarded as a non-binding guideline for the orientation of our customers; a legal claim shall therefore only exist on the basis of the prices communicated in writing. Ancillary services such as accommodation costs, travel expenses and the like are shown separately in our quotations for each individual case.
Cancellations & postponements:
For cancellations later than twelve weeks before the start of the event, we charge 50% cancellation costs; later than one week before the start of the event, we charge 80% cancellation costs of the respective project value. In the case of postponements, we will endeavour to find an optimal solution for you, but for postponements later than one week before the start of the event, we will charge 30% of the respective project value.
Implementation:
If an event cannot be held due to the absence of the trainer, force majeure or other unforeseen events, there is no right to implementation, but you can choose between postponement or cancellation free of charge. If a scheduled event is not feasible in attendance due to an infectious event (such as Covid 19) and an online alternative is declined by the client, the above cancellation arrangements apply.
Due date:
All payments are only due retrospectively, i.e. after the service has been provided, when the invoice is issued. Invoicing takes place after each individual training module
Customer approach according to § 107 TKG
MENSCH IN BEWEGUNG – the forum for personal and organisational development – invites its customers at irregular intervals to free and chargeable events and uses the medium of electronic mail for this purpose.
We would like to point out that all forms of contact with our customers are in full accord with the provisions of the Telecommunications Act, in particular §107 TKG on the regulation of unsolicited communication. Customer data is acquired exclusively through the sale of services or in the context of the provision of services or comes about as a result of personal contact with one of our trainers.
The information presented in our mailings is an additional source of information for our customers or serves to promote our own products and services.
Our clients have the option at any time to decline the receipt of such messages free of charge and without any problems by sending an informal e-mail, whereby this option is explicitly pointed out in each mailing.

Place of jurisdiction
Unless otherwise agreed, the place of jurisdiction is the respective registered office of the trainer.
The legal relationship between MENSCH IN BEWEGUNG and its clients shall be governed exclusively by Austrian law.
Liability
We guarantee the best possible training and execution of all exercises. If exercises exceed our area of competence, we usually call in trained partner companies to accompany us during exercises (e.g. outdoor). In any case, the following applies: Liability for damages arising from the participation in the activities (event) in accordance with the order shall be borne exclusively by the client in his capacity as organiser.
